These Terms and Conditions, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies posted on the website, govern your use of the website and any purchases made through it.

In these Terms:

  • “Liberty Build Co.,” “we,” “us,” and “our” refer to Liberty Build Co.
  • “You” and “your” refer to any visitor, customer, account holder, or purchaser using the Site.

Acceptance of These Terms

By accessing the Site, creating an account, submitting an order, or purchasing a product, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

Do not use the Site or place an order if you do not agree to these terms.

We may refuse service, restrict access, cancel orders, or terminate accounts when reasonably necessary to enforce these terms, protect our business or customers, prevent fraud, or comply with applicable law.

Age and Legal Eligibility

The Site is intended for adults who are at least 18 years old.

By using the Site, you represent that:

  • You are at least 18 years old.
  • You are legally capable of entering into a binding agreement.
  • The information you provide is accurate and complete.
  • You are not prohibited from purchasing, possessing, receiving, or using the products ordered.
  • Your purchase complies with all applicable federal, state, and local laws.

Certain products have additional minimum-age requirements.

Federal law generally requires a purchaser to be at least 18 to purchase rifles, shotguns, or corresponding ammunition from a federally licensed dealer. A purchaser generally must be at least 21 to purchase handguns, frames, receivers, firearms other than rifles or shotguns, or ammunition other than rifle or shotgun ammunition from a federally licensed dealer. Higher state or local age requirements also apply when applicable.

We may require age verification, identification, dealer information, or other documentation before processing an order.

Legal Compliance and Restricted Products

You are solely responsible for knowing and complying with the laws that apply to your location and intended use of a product.

By placing an order, you represent that:

  • The product is legal for you to purchase, receive, possess, install, and use.
  • You are not purchasing for a prohibited person.
  • You will not transfer the product to a prohibited person.
  • You will not use the product for unlawful purposes.
  • You have obtained any license, permit, registration, tax stamp, approval, or authorization required by law.
  • You will comply with all applicable storage, transportation, transfer, and use requirements.

Licensed firearm dealers must comply with applicable federal, state, and local restrictions at the place of sale or delivery.

We reserve the right to:

  • Refuse or cancel an order.
  • Restrict products by state, county, city, ZIP code, territory, or other jurisdiction.
  • Request identification or additional documentation.
  • Require shipment to a Federal Firearms Licensee.
  • Contact the receiving dealer before shipment.
  • Cancel an order when legal eligibility cannot be confirmed.
  • Correct or cancel an order placed because of a website, pricing, inventory, or compliance error.

An order confirmation does not mean that an order has been finally accepted or approved for shipment.

Firearms and Serialized Products

Firearms and serialized products will be sold, shipped, and transferred only in accordance with applicable law.

When shipment to a Federal Firearms Licensee is required:

  • The customer must select or provide an eligible receiving dealer.
  • The receiving dealer must provide a valid license and any required documentation.
  • The customer must complete all required forms, identification checks, and background-check procedures.
  • The receiving dealer may charge a separate transfer fee.
  • Liberty Build Co. is not responsible for fees charged by the receiving dealer.
  • Failure to pass or complete the transfer process may result in cancellation, return shipping, restocking charges, or other nonrefundable expenses.

Frames and receivers are treated as firearms and generally may not be transferred by a federally licensed dealer to anyone under 21.

You must inspect a firearm or serialized product at the receiving dealer before accepting the transfer. Do not complete the transfer if the product is damaged, incorrect, or unacceptable.

After a transfer is completed, the product generally cannot be returned to Liberty Build Co. Warranty concerns may need to be handled through the manufacturer.

Product Information and Compatibility

We make reasonable efforts to provide accurate product descriptions, specifications, photographs, availability, compatibility information, and pricing.

However:

  • Product colors may appear differently on different screens.
  • Manufacturers may revise products or packaging without notice.
  • Photographs may show optional accessories that are not included.
  • Compatibility may depend on the exact model, generation, configuration, tolerance, installation method, or other components used.
  • Product descriptions and specifications may contain errors.

You are responsible for verifying compatibility before purchase.

Contact us before ordering when you are uncertain whether a product will fit or function with your firearm, optic, frame, slide, receiver, accessory, or other equipment.

Installation should be performed by a qualified person when appropriate. Liberty Build Co. is not responsible for damage, injury, malfunction, or loss caused by improper installation, incompatible components, unauthorized modification, misuse, or failure to follow manufacturer instructions.

Prices and Payment

Prices are listed in United States dollars unless otherwise stated.

Prices, promotions, discounts, shipping charges, availability, and product information may change without notice.

You agree to provide current, complete, and accurate billing and payment information.

We may:

  • Verify payment information.
  • Place an authorization hold.
  • Request additional identity or fraud-verification information.
  • Cancel an order if payment cannot be verified.
  • Correct an obvious pricing or listing error.
  • Limit quantities.
  • Refuse orders suspected of fraud, resale abuse, unlawful activity, or policy violations.

You are responsible for applicable taxes, shipping charges, transfer fees, carrier charges, and other fees disclosed during checkout or imposed by a third party.

Orders and Acceptance

Submitting an order is an offer to purchase products under these terms.

We may accept or reject an order for reasons including:

  • Product unavailability.
  • Incorrect pricing or product information.
  • Payment failure.
  • Suspected fraud.
  • Address problems.
  • Legal or compliance restrictions.
  • Quantity limitations.
  • Dealer-license issues.
  • Manufacturer or distributor restrictions.
  • Website or inventory errors.

A contract for sale is formed only when we accept the order and begin fulfillment or shipment, subject to any required legal transfer process.

Shipping, Returns, and Refunds

Shipping is governed by our Shipping Policy.

Returns, cancellations, exchanges, restocking fees, and refunds are governed by our Return and Refund Policy.

Those policies are incorporated into these Terms and Conditions.

Original shipping charges, return shipping, transfer fees, background-check fees, payment-processing costs, special-order costs, and other incurred expenses may be nonrefundable as stated in the applicable policy.

User Accounts

You may be permitted to create a customer account.

You are responsible for:

  • Providing accurate information.
  • Keeping your login credentials confidential.
  • Restricting access to your account and devices.
  • All activity performed through your account.
  • Promptly notifying us of suspected unauthorized access.

You may not:

  • Create an account using false information.
  • Impersonate another person or business.
  • Use another person’s account without permission.
  • Attempt to defeat security, age, fraud, or legal-compliance controls.
  • Use the Site for unlawful activity.

We may suspend or terminate accounts when reasonably necessary to protect the Site, customers, or our legal rights.

Acceptable Use

  • Purchase products for a prohibited person.

  • Software
  • Branding
  • Custom product designs

You may use the Site only for personal, lawful shopping and informational purposes.

You may not reproduce, distribute, modify, publish, sell, license, commercially exploit, or create derivative works from Site content without prior written permission.

Manufacturer names, logos, and trademarks belong to their respective owners and are used only to identify applicable products.

User-Submitted Content

When you submit reviews, photographs, comments, messages, or other content, you represent that:

  • You own or have permission to submit it.
  • It is accurate and lawful.
  • It does not infringe another person’s rights.
  • It does not contain malware, threats, harassment, obscenity, or unlawful material.

You grant Liberty Build Co. a nonexclusive, royalty-free, worldwide license to use, reproduce, display, and distribute submitted content for operating, promoting, and improving the business, subject to applicable privacy law.

We may remove submitted content at our discretion.

The Site may use or link to third-party services, including:

Manufacturer warranties, when available, are provided by the manufacturer and are subject to the manufacturer’s terms.

Nothing in these Terms excludes warranties, rights, or remedies that cannot legally be excluded.

Assumption of Risk

Firearms, firearm components, ammunition, tools, optics, and tactical equipment can cause serious injury, death, or property damage if improperly installed, handled, stored, maintained, or used.

You assume responsibility for:

  • Safe and lawful possession.
  • Proper installation.
  • Correct fit and compatibility.
  • Proper maintenance and inspection.
  • Following manufacturer instructions.
  • Using appropriate protective equipment.
  • Obtaining qualified gunsmith assistance when necessary.
  • Preventing access by unauthorized persons.
  • Complying with all safety and storage requirements.

Do not use any product that appears damaged, defective, improperly installed, or incompatible.

Limitation of Liability

To the fullest extent permitted by law, Liberty Build Co. and its owners, employees, agents, affiliates, suppliers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

  • Use or inability to use the Site.
  • Product misuse.
  • Improper installation.
  • Incompatible components.
  • Unauthorized modification.
  • Carrier delays, loss, or theft.
  • Third-party services.
  • Account compromise caused by the customer.
  • Violation of applicable law.
  • Reliance on inaccurate information supplied by the customer.

Where liability cannot legally be excluded, our total liability relating to a product or transaction will not exceed the amount paid for the applicable product, except where a different remedy is required by law.

Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Liberty Build Co. and its owners, employees, agents, affiliates, suppliers, and service providers from claims, losses, liabilities, damages, judgments, penalties, and reasonable legal expenses arising from:

  • Your violation of these Terms.
  • Your unlawful or improper use of the Site or a product.
  • Your misrepresentation of age, eligibility, identity, or legal authority.
  • Your transfer of a product to a prohibited person.
  • Your infringement of another party’s rights.
  • Your submitted content.
  • Your improper installation, modification, storage, handling, or use of a product.

This section does not apply to the extent prohibited by law.

Governing Law

These Terms and any transaction with Liberty Build Co. are governed by the laws of the State of Utah and applicable federal law, without regard to conflict-of-law principles.

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Disputes and Venue

Any legal action arising from these Terms, the Site, or a purchase from Liberty Build Co. must be brought in a court with jurisdiction in Washington County, Utah, unless applicable law requires a different venue.

You consent to the jurisdiction of those courts.

The original template incorrectly said disputes would be “arbitrated by state or federal court.” Courts decide lawsuits, while arbitration is a separate process. This version does not impose mandatory arbitration.

Utah law establishes venue rules for written-contract disputes, so any venue provision remains subject to mandatory law.

Changes to These Terms

We may update these Terms to reflect changes in our business, website, products, policies, service providers, or legal obligations.

Updated Terms will be posted on this page with a revised “Last updated” date.

Changes apply prospectively from the date posted unless otherwise required by law.

Your continued use of the Site after an update constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.

No Waiver

Our failure to enforce any provision does not waive our right to enforce that provision later.

Entire Agreement

These Terms, together with the policies and notices incorporated into them, constitute the entire agreement between you and Liberty Build Co. regarding the Site and purchases made through it.

They replace prior understandings or communications concerning the same subject matter.
